Introduction

The following are the terms and conditions of service, representing the basis upon which driving lessons are offered to you, The Trainee, By Me the Driving instructor

General Conduct

Instructors are bound by a professional code of conduct and will be courteous, polite, tidy, and punctual.

They will always behave in a professional and ethical manner and will try to avoid any physical contact, with the exception of course, of any emergency or during normal greeting. The tuition vehicle will be fitted with dual controls as part of the standard equipment and will be well maintained, clean, tidy, and smoke free. The car will be fully insured for driving tuition.

Supervision

The instructor will make their service available for the sole purpose of providing driving tuition at the rate per hour from time to time agreed and shown on the current price list

Qualifications

As a minimum all instructors are licensed by the (DSA) Driving Standards Agency to give driving tuition.

Prices

Prices are subject to change & are normally kept at the starting price, but prices can vary from trainee to trainee.

Driving License & Eyesight

Trainees’ MUST be in possession of a valid driving license (provisional or full), Which must be produced on, or in advance of the first lesson. Trainees’ must also ensure that they are able to read a vehicle registration plate, in good daylight and at a minimum distance of 20.5 Meters (67 Feet or about 5 Car lengths) with glasses or contact lenses if normally worn.

Driving offences

Legally when you are driving a car even as a learner you are responsible for the car and anyone under the age of 14 & will have the fines & / or points, as well as any legal fee involved.

This includes motoring offences like

Speeding
Running red lights
Running someone over
Driving on the wrong side of the road
Driving under the influence

Payments

All payments for tuition should be made on the day of or in advance of the lesson, there are no back payments unless otherwise arranged.

Payments should be made promptly either by cash or direct bank transfer to the instructor.

Cancelations & Postponements

All cancellations MUST be made direct to the instructor and MUST be made in at least 48 Hours in advance.

Cancelations do happen from time to time and that is understandable but as there is still the running of the car to take in to account, road tax & insurance to name two.

There are certain conditions when canceling lessons.

1st late cancelation (under 24 hours’ notice) is free (everyone has a last-minute emergency from time to time)
Any cancellation under 24 hour’s (after 1st freebie) incurs a fee of the full lesson price (whatever the length of lesson which was booked in), To be paid before (paid by bank transfer) of the next booked lesson, before the next lesson will take place.

Any pupil/customer who cancels more the Three consecutive lesson (even if giving the minimum of 48 hours’ notice for each cancelation) will have one warning, if they then cancel another lesson within a month, they will not be invited to book another lesson.

Punctuality & non-attendance

Trainees are respectfully advised to be punctual for their appointment, which will be recorded and checked by the instructor, the number of minutes the Trainee is late will be deducted from the lesson. Were it is possible instructors will wait and depart after a maximum of 20 minutes, then the lesson will be terminated and the full fee in respect of that appointment may be forfeited or charged, the amount to be paid by bank transfer before the next lesson.

A reciprocal waiting time may become necessary by the trainee if the instructor is delayed dues to unforeseen circumstances. Any lesson time lost because of this will normally be made up by the instructor either at the end of the normal lesson time or at a later date.

Driving under the influence

To ensure the safety of you, your instructor and other road users your instructor reserves the right to cancel any lesson if you are, or if they suspect you are, under the influence of drugs and/or alcohol. Should this occur the full training fee for the appointment will be forfeited or charged. We reserve the right to refuse future tuition in these circumstances.

The Practical Driving Test

Bookings, driving test must be booked by the trainee. Driving test bookings always take priority over other lessons and therefore, lessons may be postponed allowing for someone else’s driving test and vice versa. Changes to lesson bookings because of this will be notified immediately. All test appointments must be notified to your instructor as soon as they are known; otherwise, they cannot guarantee to provide a vehicle for the practical driving test. The instructor cannot be held responsible for a driving test which have been double booked.
Location of the test is to be agreed by the instructor and the candidate (normally the location where the training is being held).
Use of the vehicle, In the interest of customer and public safety instructors reserve the right to withhold the use of a car for the test if, in their opinion, the trainees’ driving is actually or potentially dangerous.
The price for the use of the instructor’s car is 2 hours of the instructor’s current hourly rate.

If the test is booked at weekend or out of the area of work for the instructor, the rate will be charged at 2 hours of the instructor’s current hourly rate plus an additional £100fee.

Test cancellations, 10 clear working days’ notice of cancellation or postponement is required by the DSA. Failure to provide the required notice will result in the loss of your test fee. Instructors cannot be held responsible for any postponement or cancellation of tests by you or the DSA. However, they will do all that is possible to arrange another test as quickly as possible and to help you to reclaim expenses from the DSA.
Changing Test Bookings, from end of March 2026 the DVSA will be only allowing 2 changes to the test bookings, these include changing the Time, date, and or location of the test.

Taking the Practical Driving Test

Being Test ready. When booking the practical driving test, It is on the understanding that the candidate will be passing at least 50% of mock Test taken, the candidate has up to 2 weeks before the date of the test, this is the deadline to be ready by. If the candidate is not passing the agreed amount of mock test by this deadline. There is a high possibility that the candidate’s test will not go ahead in the instructor’s car or with the instructor present. This is due to the candidate not being ready for the test

Statutory Rights

Nothing in these terms and conditions of service will reduce your statutory rights relating to faulty goods or services provided. Instructors have statutory obligations to provide goods & services fit for the purpose for which they were bought and as described. If you have any doubts about your statutory rights, please contact your local Trading Standards Department or Citizens Advice Bureau.
